Welcome to Diamond Data PRO. These Terms of Use govern your access to and use of the Diamond Data PRO mobile application and website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Use of the Service
Diamond Data PRO provides tools that analyze baseball statistics and generate optimized batting lineups based on statistical inputs.
The Service is intended for informational and analytical purposes only. Users are responsible for verifying the accuracy of the data they enter and for how they use any analysis produced by the Service.
You agree not to misuse the Service, including attempting to interfere with or disrupt the application or its underlying systems.
2. User Accounts
Certain features of the Service may require an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information when creating an account.
3. Subscriptions
Diamond Data PRO offers optional paid subscriptions that unlock premium features.
Subscriptions may be offered on a monthly or annual basis and will automatically renew unless canceled before the renewal date.
Payments are processed through the Apple App Store or Google Play Store depending on your device.
Subscription management, billing, and cancellation must be handled through your Apple or Google account settings.
If you cancel your subscription, you will continue to have access to premium features until the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current billing period.
4. Refunds
All purchases and refunds are handled through the Apple App Store or Google Play Store in accordance with their respective policies.
Diamond Data PRO does not directly process refunds.
5. Intellectual Property
The Diamond Data PRO application, including its design, algorithms, content, and branding, is the property of Diamond Data PRO and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, or reverse engineer the Service without prior written permission.
6. Disclaimer
The Service provides statistical analysis and projections based on user-provided data.
Diamond Data PRO does not guarantee any specific results, athletic performance improvements, or outcomes.
All information provided by the Service is for informational purposes only.
The Service provides statistical analysis and lineup optimization tools intended to assist coaches and players in evaluating baseball performance data. The Service does not provide professional coaching advice, scouting advice, recruiting guidance, or guarantees of athletic performance or outcomes. Any decisions made based on information generated by the Service are the sole responsibility of the user. Users are responsible for evaluating and verifying the accuracy of their data and for how they choose to use any results produced by the Service.
The Service may experience interruptions, errors, or technical issues from time to time. While Diamond Data PRO strives to maintain reliable service, we do not guarantee that the Service will always be available, uninterrupted, or error-free. Users are responsible for maintaining their own copies of important data. Diamond Data PRO is not responsible for any loss of data, corruption of information, or interruption of service that may occur while using the Service.
7. Limitation of Liability
To the fullest extent permitted by law, Diamond Data PRO shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of the Service.
8. Changes to These Terms
We may update these Terms from time to time. Updated versions will be posted on this page with a revised "Last Updated" date.
Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

10. Limitation of Liability
Diamond Data PRO provides statistical analysis and informational tools based on user-provided data. The Service is provided on an “as-is” and “as-available” basis.
To the fullest extent permitted by law, Diamond Data PRO, its owners, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or other intangible losses arising out of or related to the use of, or inability to use, the Service.
Diamond Data PRO does not guarantee any particular athletic performance, coaching result, lineup outcome, or competitive success resulting from use of the Service.
In no event shall the total liability of Diamond Data PRO for any claim arising out of or relating to these Terms or the Service exceed the amount paid by the user for the Service during the twelve (12) months preceding the claim.
11. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to the Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association.
The arbitration shall take place in Pinellas County, Florida. Judgment on the arbitration award may be entered in any court having jurisdiction.
The parties agree that any dispute will be resolved on an individual basis and waive any right to participate in a class action or class-wide arbitration.
If any claim is determined to be non-arbitrable, the parties agree that exclusive jurisdiction and venue shall lie in the Circuit Court for Pinellas County, Florida, and the parties consent to the personal jurisdiction of that court.
Diamond Data PRO is a subscription-based mobile application available on the Apple App Store and Google Play.
